Terms and Conditions

  1. Introduction

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you, whether acting as an individual or a legal entity “User”, and LasPay Electronic Money Institution (EMI) “LasPay”, governing your access to and use of LasPay’s electronic money services, including the mobile application, web platform, digital wallet, and any related services (collectively, the “Services”). LasPay is duly licensed and regulated by Da Afghanistan Bank (DAB) as an Electronic Money Institution. By creating a LasPay wallet, accessing the Services, or conducting any transaction through LasPay, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you may not use the Services.

  1. Regulatory Compliance and Custody of Funds

LasPay provides electronic money services in compliance with the laws of Afghanistan, Da Afghanistan Bank regulations, and applicable KYC, CDD/EDD, and anti-money laundering and counter-terrorist financing requirements. Customer funds held in LasPay wallets are maintained on a custodial basis and are fully backed on a one-to-one basis in accounts with regulated financial institutions. Electronic money issued by LasPay is stored electronically and does not constitute a bank deposit, investment product, or interest-bearing account. LasPay does not invest, lend, pledge, or otherwise use customer funds for its own purposes, and users may withdraw their available balances at any time, subject to applicable transaction limits, regulatory requirements, system availability, and security controls. Transaction limits, including per-transaction, daily, and monthly caps, vary based on the User’s verification level and regulatory requirements. LasPay reserves the right to amend such limits at any time to comply with DAB regulations, risk management policies, or legal obligations.

  1. Eligibility and Account Creation

Eligibility to use LasPay Services is limited to natural persons and entities legally permitted under the laws and regulations of Afghanistan. Users must provide accurate, complete, and truthful information during registration and throughout their relationship with LasPay. LasPay reserves the right to refuse, restrict, suspend, or terminate access to the Services where required by law, regulation, risk assessment, or internal compliance policies. Account creation may occur instantly or progressively depending on regulatory thresholds, KYC tiers, and risk profiling. Users acknowledge that LasPay may impose transaction limits, functionality restrictions, or enhanced verification requirements based on the level of customer due diligence completed.

  1. Identity Verification and Monitoring

LasPay may, at any time, request identity verification documents, including national identification (Tazkira or passport), proof of address, business licenses, beneficial ownership information, or any other documentation deemed necessary for compliance purposes. Failure to provide requested documentation may result in limitation, suspension, or closure of the wallet without prior notice. All transactions conducted through LasPay are subject to continuous monitoring for compliance with AML/CFT laws, sanctions regimes, and DAB directives. LasPay may report suspicious or unusual activities to competent authorities, including filing Suspicious Transaction Reports (STRs) or Suspicious Activity Reports (SARs), without notifying the User, where disclosure is prohibited by law.

  1. Services

Subject to regulatory approval and system availability, LasPay Services may include electronic wallets, peer-to-peer transfers, salary and bulk disbursements, merchant and QR payments, cash-in and cash-out services through authorized agents, transfers to linked bank accounts, bill payments. LasPay only provides access to third-party services such as travel and hotel bookings and purchases, which are governed by their own terms, and LasPay is not responsible for any issues arising from them. LasPay does not guarantee uninterrupted access to any service and may modify, suspend, or discontinue any feature when required for legal, technical, or operational reasons.

  1. Fees, Charges, and Taxes

Fees and charges applicable to LasPay Services, if any, are disclosed through LasPay’s digital platforms and form an integral part of these Terms. LasPay may revise fees upon notice, and continued use of the Services following such notice constitutes acceptance. All applicable taxes, duties, or government charges shall be borne by the User.

  1. Transaction Responsibility and Bulk Payments

Users initiating transactions acknowledge that they are solely responsible for verifying the accuracy of the receiver’s information, including details related to users, agents, institutions, and billers. Once a transaction is completed, it is generally final and cannot be reversed, except where law, technical capabilities, and regulatory approvals permit reversal. All completed transactions are considered final. Refunds or manual reversals may be attempted at LasPay’s discretion if funds remain unused and with the recipient’s consent, subject to regulatory approval. In cases where a transaction fails, meaning funds are debited but not successfully processed, LasPay will investigate and refund the amount once the failure is confirmed. Transactions involving third-party services are governed by the respective provider’s terms, and LasPay is not responsible for outcomes determined by third-party policies.

  1. Security and User Obligations

Users are responsible for maintaining the confidentiality of login credentials, PINs, passwords, and one-time verification codes. LasPay shall not be liable for losses arising from user negligence, unauthorized disclosure of credentials, phishing, social engineering, or misuse of the account. Users must promptly notify, through provided mobile number or email, LasPay of any suspected unauthorized access or security breach.

  1. Customer Data Protection and Privacy

LasPay collects, processes, stores, and uses Users’ personal and transactional data solely for the provision of the Services, compliance with Afghanistan applicable laws, DAB requirements, AML/CFT obligations, fraud prevention, and system security. By using the Services, Users consent to such data processing and acknowledge that LasPay may share information with authorized service providers, agents, payment partners, and competent authorities where required by law, regulation, or court order. LasPay applies reasonable administrative, technical, and organizational safeguards to protect User data but does not guarantee absolute security of electronic systems. User data is retained only for as long as necessary to meet legal, regulatory, and operational requirements and is not sold or disclosed for unrelated commercial purposes without users’ consent.

  1. Prohibited Use

The Services must not be used for unlawful, fraudulent, or prohibited activities, including money laundering, terrorist financing, sanctions violations, or abuse of LasPay systems. LasPay may immediately suspend or terminate access and report such activities to relevant authorities where required.

  1. Suspension and Termination

LasPay may suspend or terminate a User’s wallet where required by law, regulatory directive, competent court order, or where risk, fraud, or non-compliance is identified. Any remaining balance shall be handled in accordance with applicable laws and DAB regulations.

  1. Intellectual Property

All intellectual property related to LasPay, including software, applications, logos, trademarks, content, and systems, remains the exclusive property of LasPay or its platform licensors. No rights are granted except for limited use of the Services in accordance with these Terms.

  1. Limitation of Liability

To the maximum extent permitted by law, LasPay shall not be liable for direct, indirect, incidental, or consequential losses, service interruptions, force majeure events, or failures attributable to third parties. LasPay’s liability, if any, shall be limited to the value of the affected transaction.

  1. Governing Law and Jurisdiction

These Terms are governed by the applicable laws and regulations of Afghanistan, especially issued by Da Afghanistan Bank. Disputes should first be resolved in good faith (bilateral negotiation); if unresolved, Afghanistan competent courts shall have exclusive jurisdiction unless otherwise mandated by law.

  1. Amendments

LasPay may amend these Terms at any time. Updated Terms become effective upon publication through LasPay platforms, and continued use of the Services constitutes acceptance of the amended Terms.

  1. Acceptance

By creating a LasPay wallet or using any LasPay Services, you confirm that you have read, understood, and agreed to be legally bound by these Terms.
